29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average (TWA) sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) On or about November 28, 2012 - Polisher, an employee was exposed to a continuous noise level at 209.7% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA or a dose of 100%) during the 444 minute sampling period on December 17, 2012. Exposure calculations include a zero increment for the 36 minutes not sampled. The equivalent dBA of the employee is approximately 95 dBA, which exceeds the 8-hour TWA of 85 or equivalently a dose of 50%. (b) On or about November 28, 2012 - Reliner, an employee was exposed to a continuous noise level at 100.3% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA or a dose of 100%) during the 448 minute sampling period on December 17, 2012. Exposure calculations include a zero increment for the 32 minutes not sampled. The equivalent dBA of the employee is approximately 90 dBA, which exceeds the 8-hour TWA of 85 or equivalently a dose of 50%. (c) On or about November 28, 2012 - Operator, an employee was exposed to a continuous noise level at 72.18% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA or a dose of 100%) during the 434 minute sampling period on December 17, 2012. Exposure calculations include a zero increment for the 46 minutes not sampled. The equivalent dBA of the employee is approximately 88 dBA, which exceeds the 8-hour TWA of 85 or equivalently a dose of 50%.
