29 CFR 1926.304(d): All portable, power-driven circular saws were not equipped with guards above and below the base plate or shoe. The upper guard did not cover the saw to the depth of the teeth, except for the minimum arc required to permit the base to be tilted for bevel cuts. The lower guard did not cover the saw to the depth of the teeth, except for the minimum arc required to allow proper retraction and contact with the work. When the tool is withdrawn from the work, the lower guard did not automatically and instantly return to the covering position: This violation recently occurred on November 29, 2012, at 620 S Greenville Ave., Richardson, TX; employees were framing condominium homes with power circular saws that did not have properly working blade guards.
