29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a. On or about December 15, 2012, an employee using a Hitachi NR83A2 pneumatic air nail gun was not wearing safety glasses, exposing himself to being hit by nails or flying debris.     b. On or about December 15, 2012, an employee using a Bostich pneumatic air nail gun was not wearing safety glasses, exposing himself to being hit by nails or flying debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. On or about December 15, 2012, on the 2nd floor, three employees performing framing operations were not protected from an 11 feet 6-inch fall hazard by use of a guardrail system, safety net system, personal fall arrest system or any alternate fall protection.
