29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) At the new residential construction at Harley Farms subdivision Lot # 104, 211 Ashley Nicole Avenue Bonaire, Georgia 31005: On or about June 8, 2023, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that eye protection was not provided to employees operating these tools.

29 CFR  1926.304(d): When the tool was withdrawn from the work, the lower guard did not automatically and instantly return to the covering position.  a) At the new residential construction Lot # 104, 211 Ashley Nicole Avenue Bonaire, Georgia, 31005 Harley Farms Subdivision:  Ground Floor: On or about 6/8/2023,  and at times prior, the employer exposed the employees to severe laceration and/or amputation hazards, in that the lower guards were not operational during use as a wood shim was used to keep the lower blade guard was in a fixed position.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  a) At the new residential construction, roof: Lot # 104 211 Ashley Nicole Avenue Bonaire, Georgia 31005 Harley Farms Subdivision: On or about 06/08/2023, and at time prior, the employer exposed employees to fall hazards of 19-feet 6-inches to the lower level, in that employees were not provided with a fall protection system while installing plywood sheathing on the roof.
