29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. At this jobsite an employee worked while standing on one pre-fabricated, metal frame scaffold plank while performing carpentry and framing work without fall protection. The scaffold plank was approximately 12 feet above ground level.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist emmployees in mounting and dismounting the ladder: Employees working on the roof of the building under construction did not have a ladder which reached 36 inches above the surface being access. Employees used a step-ladder in its closed position to access the roof. The step ladder was not tied to prevent movement nor was a grab bar available for grasping.
