29 CFR 1910.272(e)(1)(ii): Current employees and new employees prior to starting work in the grain handling facility were not trained in the specific procedures and safety practices applicable to their job tasks including but not limited to cleaning procedures for grinding equipment, clearing procedures for choked legs, housekeeping procedures, hot work procedures, preventive maintenance procedures and lock out tag out procedures.     On or about 12/13/2012, In grain bin number 8, located at 104 East South Street, Advance Missouri, employees were allowed to enter the bin to shovel wheat in to a sub-ground auger without providing the necessary training to enable them to conduct their task without exposing themselves to unguarded augers. One of the two employees stepped in to the unguarded auger and sustained sever injuries to his foot and leg. The auger was not covered or locked out while the employees were in the bin.

29 CFR 1910.272(g)(1)(iii): The atmosphere within a bin, silo, or tank in the grain handling facility was not tested for the presence of combustible gases, vapors, and toxic agents prior to employee entry:     On or about, 12/13/2012, in Storage bin number 8, employees were allowed to enter the to clean out the wheat without testing the atmosphere for potential hazards such as but not limited to low oxygen amount and and grain dust. The employees were shoveling wheat towards the center of the the bin, where it was transported out on to a truck.

29 CFR 1910.272(h)(2)(i): Whenever an employee walks or stands on or in stored grain or grain products of a depth which poses an engulfment hazard, all equipment which presents a danger to that employee (such as an auger or other grain transport equipment) shall be deenergized, and shall be disconnected, locked-out and tagged, blocked-off, or otherwise prevented from operating by other equally effective means or methods.     On or about 12/13/2012, the employer did not ensure the following equipment located in grain storage bin No. 8, were deenergize or locked out prior to allowing employee to enter the storage bin. One of the employees stepped through an open floor that housed an auger and sustained several foot bone fractures and left femur.     a) Main auger, with 12 X12 inches opening,  located  at the center of the floor, where the employees shoveled wheat in to, was not covered or deenergized.     b)  A 20 foot long Sweep auger, that moved the grain in to the center of the floor to enable employees to shovel the grain was not guarded or deenergized.

29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees, in that the employer did not ensure the safety of the equipment pursuant to the considerations in sections (i) through (viii) of 29 CR 1910.303(b)(1):     on or about 12/13/2012, an electrical  cord supplying power to the motor of a sweep auger used to move grain to the center floor of storage bin No. 8 was not protected from damage. The cord was repaired with black electrical tape.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:   On or about 12/13/2012, in grain storage bin number 8, where employees wore 3M disposable respirators while cleaning out wheat, the employees were not provided training on the use and limitation of the respirators.
