29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) At 12021 Jericho Drive Daphne, Alabama: On or about January 4, 2013 and at times prior; the employer exposed his employees to fall hazards in that employees were allowed to access the top plate of framed walls that were 9 feet above the concrete with a 6 foot step ladder where the side rails did not extend 3 feet above the upper landing surface. The employer provided a 6 foot Werner step ladder to access 9 feet to the next level.

29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed. a) 12021 Jericho Drive, Daphne, AL 36526: On or about January 4, 2013 and at times prior thereto, the employer exposed his employees to a 9 foot fall while they were using the top of the stepladder to reach the upper landing surface. According to Werner, the manufacturer of the 6' step ladder, the "employees should not stand above the second step from the top of a stepladder or the fourth rung from the top of an extension ladder".
