OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees working at the drilling rig located at SEC 32, TWP 19, R 9, 990 fsl, 440 fwl, Chase, Kansas were exposed to struck-by hazards. The employer had not done inspections of the hoisting equipment to ensure their safe operations. Among other methods, one feasible and acceptable method is to conduct and record inspections of hoisting equipment as stated in American Petroleum Institute (API) Recommended Practice for Procedures for Inspections, Maintenance, Repair, and Remanufacture of Hoisting Equipment, 1997 edition, paragraph 1.3 Procedure Development. "The owner and user together with the manufacturer should jointly develop and update inspection, maintenance, repair and remanufacture procedures consistent with equipment application, loading, work environment, usage, and other operational conditions."

29 CFR 1910.24(c): Fixed stairway(s) were not designed and/or constructed to carry a load of five times the normal live load anticipated or the strength to carry safely a moving load of 1000 pounds: Employees using the stairs to the doghouse at the drilling rig location SEC 32, TWP 19, R 9, 990 fsl, 440 fwl, Chase, Kansas were exposed to slip and trip hazards in that 7th stair tread was broken away from the runner causing the stair flex.

29 CFR 1910.24(h): Standard railings were not provided on the open sides of all exposed stairways and stair platforms: Employees using the stairs at the drilling rig located at SEC 32, TWP 19, R 9, 990 fsl, 440 fwl, Chase, Kansas from were exposed to fall hazards of approximately 8 feet to the ground in that the handrail for the fixed industrial stairs from the drill deck to the pipe rack was not installed. Maverick Drilling, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.24(h), which was contained in OSHA inspection number 315086223, citation number 01, item number 001 and was affirmed as a final order on 04/19/2011, with respect to a workplace located at SEC 24, TWP 26, R 12, Preston, Kansas. Maverick Drilling, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.24(h), which was contained in OSHA inspection number 312801566, citation number 01, item number 003 and was affirmed as a final order on 09/14/2009, with respect to a workplace located at SEC 23, TWP 10, R 15, Natoma, Kansas.
