OSH Act of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible wood dust fire hazards while working at or an near indoor enclosureless dust collector units which were being utilized with equipment recognized by the woodworking industry of having a history of producing frequent sparks (a large belt sander/planer and a moulder having mechanical material feed systems) and while in near-proximity to indoor enclosureless dust collector units being utilized with other woodworking equipment (ripsaws):    Care Caskets Int'l, LLC - Wharton, Ohio: On or about December 7, 2012 and January 17, 2013;    a) An indoor enclosureless dust collector unit (Extrema) was used to collect combustible wood dust from a large belt sander/planer with a mechanical material feed system (Timesavers), exposing the operator and any nearby employees to fire hazards.    b) An indoor enclosureless dust collector unit (Grizzly) was used to collect combustible wood dust from a moulder with a mechanical material feed system (Bridgewood), exposing the operator and any nearby employees to fire hazards.    c) An indoor enclosureless dust collector unit (Grizzly) was used to collect combustible wood dust from a ripsaw with a mechanical material feed system (Incor), exposing the operator and any nearby employees to fire hazards.    d) An indoor enclosureless dust collector unit (Grizzly) was used to collect combustible wood dust from a gang ripsaw (Raimann USA) and from a single ripsaw (Bridgewood), exposing the operators and any nearby employees to fire hazards.    Among other methods, a feasible and acceptable method to correct this hazard would be to comply with the National Fire Protection Association (NFPA) NFPA 664 "Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities, 2012 Edition" Sections 8.2.2.2.2, 8.2.2.5.1.4(7), and A.8.2.2.5.1.4(7).  Specifically, (1) for indoor enclosureless dust collectors connected to equipment having a history of producing frequent sparks (see a and b above), locate the dust collector outdoors and provide a listed method of spark detection and extinguishment within the main duct and upstream of the dust collector; and 2) for the indoor enclosureless units connected to the rip saws (see c and d above), locate the dust collectors at least 20 feet from means of egress, operator stations, other areas routinely occupied by personnel, and 20 feet from other enclosureless dust collector units.  Furthermore, the NFPA 664 standard does encourage to protecting enclosureless dust collectors with either an automatic sprinkler located above the unit or a spark detection and extinguishing system in the main duct, upstream of the unit.
