OSH ACT of 1970 Section 5(a)(1):  The employer failed furnish employment and a place of employment free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible wood dust fire hazards while working near indoor enclosureless dust collector units handling combustible wood dust being generated from upstream woodworking equipment such as, but not limited to, sanders/planers, moulders, and rip saws:    (a)   Care Caskets Intl, Inc. located at 200 East Wyandot Street in Wharton, OH: The employer failed provide a workplace free from recognized fire hazards associated with the use of indoor enclosureless dust collectors to collect combustible wood dust from upstream woodworking equipment.  The violative condition was documented at the employer's facility on September 3, 2015 and observed on October 14, 2014 to include instances such as, but not limited to, the following:      i. Extrema (model DC-3075) enclosureless dust collector collecting dry wood particulate generated from a Timesavers (model Series 2300) belt sander/planer.      ii. Grizzly (Class E Serial No: 0022YB) enclosureless dust collector collecting dry wood particulate generated from a Bridgewood (model CM-555 Serial No: 01A0210) moulder.      iii. Grizzly G0508 (Serial No: 051802) enclosureless dust collector collecting dry wood particulate generated from a Raimann ISA (model 26110) gang rip saw and a Bridgewood (model RS-366) rip saw.      Care Caskets Intl, Inc. was previously cited for a violation of this Occupational Safety and Health Standard [Section 5(a)(1) of the OSH Act of 1970], which was contained in OSHA inspection number 821402, citation number 1, item number 1, and was affirmed as final order on May 2, 2014, with respect to a workplace located at 200 East Wyandot Street in Wharton, OH.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Care Caskets Intl, LLC of Wharton, Ohio; On or about September 3, 2015 the employer failed to maintain the companys hazard communication program. The program had not been updated to reflect management officials that were no longer with the company that were assigned responsibilities within the program. Employees worked with adhesives which contained chemicals such as, but not limited to, acetone, propane, cyclohexane, hexane, and petroleum distillates.    Care Caskets Int'l LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(e)(1), which was contained in OSHA inspection number 821402, citation number 2, item number 3 and was affirmed as a final order on April 30, 2013, with respect to a workplace located at 200 East Wyandot Street, Wharton, Ohio 43359.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Care Caskets Intl, LLC of Wharton, Ohio; On or about September 3, 2015 the employer failed to train employees on the hazards of the chemicals they were working with. Employees working with adhesives were exposed to chemicals such as, but not limited to, acetone, propane, cyclohexane, hexane, and petroleum distillates.  Care Caskets Int'l LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(h)(1), which was contained in OSHA inspection number 821402, citation number 2, item number 4 and was affirmed as a final order on April 30, 2013, with respect to a workplace located at 200 East Wyandot Street, Wharton, Ohio 43359.

Care Caskets Int'l LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.134(c)(2)(I), which was contained in OSHA inspection number 821402, citation number 2, item number 1 and was affirmed as a final order on April 30, 2013, with respect to a workplace located at 200 East Wyandot Street, Wharton, Ohio 43359.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:    a)Care Caskets Intl, LLC of Wharton, Ohio; On or about September 3, 2015 the employer failed to ensure each container of hazardous chemicals in the workplace was labeled. Employees were exposed to eye, skin, and inhalation hazards in that two unlabeled bottles were observed on the work bench in the sanding area containing Titebond wood glue, an aliphatic resin product composed of polyvinyl acetate, polyvinyl alcohol, and petroleum hydrocarbon.
