29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a. On or about January 14, 2013 - at the above addressed jobsite, employees working inside a trench which consisted of several depths ranging between five (5) feet nine (9) inches to six (6) feet one (1) inch were not provided with an adequate protective system, thereby exposing the employees to cave in hazards.

29 CFR 1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations shall be in written form at the jobsite during construction of the protective system. After that time this data may be stored off the jobsite, but a copy shall be made available to the Secretary upon request. a. On or about January 14, 2013 - at the above addressed jobsite, employees were working in a trench measured between five (5) feet two (2) inches to six (6) feet in depth. Manufacturing specifications for the shoring system in use were not available in a written form at the jobsite during construction of the protective systems.
