29 CFR 1910.95(c)(1):  The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:         a)  Cylinder Repair Cell:   On or about January 29, 2013, the employer had not instituted an effective hearing conservation program, employee was exposed to continuous noise at 135% of the permissible daily noise exposure (8-hour Time Weight Average sound level of 85 dBA) during the 425 minute sampling period. For a full eight hour work shift this exposure is equivalent to an average sound level of 92.2 dBA.  Exposure calculations include a zero increment for the 55 minutes not sampled.             b)  Cylinder Repair Cell:   On or about January 29, 2013, the employer had not instituted an effective hearing conservation program, employee was exposed to continuous noise at 77.4% of the permissible daily noise exposure (8-hour Time Weight Average sound level of 85 dBA) during the 431 minute sampling period. For a full eight hour work shift this exposure is equivalent to an average sound level of 88.2 dBA.  Exposure calculations include a zero increment for the 49 minutes not sampled.

29 CFR 1910.134(d)(1)(ii):  The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification:         Nickel Plating line:  On or about January 17, 2013, an employee was wearing a filtering face piece respirator that was not a NIOSH-certified respirator while adding granular Nickel hydroxycarbonate to solution.  Nickel hydroxycarbonate is a carcinogen and irritant to the paranasal sinuses and lungs.

29 CFR 1910.1200(f)(5)(ii):  The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warning:          a)  Nickel Plating Line:  On or about January 17, 2013, employees were performing plating operations and none of the tanks were properly labeled.  The tank labels did not include the chemical name of the materials or the standard corrosive hazard warning labels.         b)  Alodine Dip Tank PMA Assembly Area:  On or about January 17, 2013, employees were dipping cylinders on the alodine dip tank line that was not labeled.  The tank did not identify the chemical name of the material or the standard symbol for corrosive material.
