29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about January 24, 2013, the employer's competent person did not perform frequent and regular inspections of the job site at 6960 Miller Lane, Dayton, Fairfield Inn hotel to recognize and address the fall hazard while employees were working on the low slope roof.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. On the flat roof of the Fairfield Inn hotel at 6960 Miller Lane, Dayton, employees removing rock ballast on the flat roof with a 12 inch parapet were exposed to at least a 33 ft fall hazard due to the lack of any fall protection being used by the company. FIVE STAR ROOFING SYSTEMS, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.501(b)(10), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315443531, CITATION NUMBER 02, ITEM NUMBER O1, AND WAS AFFIRMED AS A FINAL ORDER ON MAY 6, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 3805 W 150TH, CLEVELAND, OH 44111
