29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    Jobsite located at 3917 N. Watercress Ct, Maize, KS; employees using the portable extension ladder located on the east side of the house to access the roof were exposed to fall hazards of up to approximately 12 feet from the ladder to the ground in that the side rails of the portable extension ladder extended approximately 2 feet above the landing surface of the roof.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    Jobsite located at 3917 N. Watercress Ct., Maize, KS; employees engaged in residential roofing work were exposed to fall hazards of up to 16 feet from the roof to the ground. Fall protection available at the jobsite was not used.    Gustavo Rodriguez was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 311790752, citation number 01, item number 01, and was affirmed as a final order on 07/15/08, with respect to a workplace located at 3928 Manchester, Maize, KS 67101.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    Jobsite located at 3917 N. Watercress Ct., Maize, KS; employees engaged in residential roofing work had not been trained to recognize and minimize fall hazards.  Employees were working at heights of up to 16 feet without fall protection.    Gustavo Rodriguez was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 311790752, citation number 01, item number 02, and was affirmed as a final order on 07/15/08, with respect to a workplace located at 3926 Manchester, Maize, KS 67101.
