29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a. Hallway to Section A / Corridor 200: Employees were not wearing hard hats while working from the lower level on the scaffold while other employees were loading the the top level of the 9 feet 9 inch tall fabricated frame scaffold with masonry blocks as observed on 1-29-13.

29 CFR 1926.404(b)(1)(ii):     On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupters for personal protection:    a. Parking Area in Front Office Trailer: An employee using the Hitachi circular saw to cut wood shims was plugged into the duplex receptacle in the office trailer and there was no ground fault circuit interrupter protection as determined on 1-29-13.

29 CFR 1926.405(a)(2)(ii)(I):     Flexible cords and cables used for temporary wiring were not protected from damage:    a. Parking Area in Front Office Trailer: The red / black extension cord which provide energy to the Hitachi circular saw was exposed to damage due to vehicles had run over it while it was laying in the parking lot as observed on 1-29-13.

Corridor 200: There was a section of fabricated frame scaffold which was approximately 5 feet wide and 14 feet long by 9 feet 7.5 inches tall which had 5 of the 6 post setting on top of the base plate in lieu of the base plates being inserted in the post / legs of the scaffold and one leg was not equipped with any base plate as observed on 1-29-13. Corridor 200: There was a section of fabricated frame scaffold which was approximately 5 feet wide and 14 feet long by 9 feet 7.5 inches tall which had 5 of the 6 post setting on top of the base plate in lieu of the base plates being inserted in the post / legs of the scaffold and one leg was not equipped with any base plate. The fabricated framed scaffold was not inspected by a compentent person before employees went to work as determined on 1-29-13.    ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM

29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    a.Corridor 200: Employees were using the cross bracing to gain access to the top level of the fabricated frame scaffold which was 9 feet 7.5 inches off the ground as observed on 1-29-13.

29 CFR 1904.32(b)(3):      A company executive must certify that he or she has examined the OSHA 300 Log and that he or she reasonably believes, based on his or her knowledge of the process by which the information was recorded, that the annual summary is correct and complete.    a. 2012 OSHA Form 300A:  The 2012 OSHA Form 300A summary of work related injuries and illness was not certified by the highest ranking company executive at the facility.  The facility's Accountant, not a company executive signed the summary, as determined on February 13, 2013.
