29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1: (a) 212 Park Ave, Beckley WV 25801: On or about October 29, 2024 and times prior, an employee was operating a Stihl TS 420 handheld concrete cutting saw without proper engineering controls, exposing the employee to respirable crystalline silica.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: (a) 212 Park Ave, Beckley WV 25801: On or about October 29, 2024, an employee was standing on the elevated forks of a TL493 CAT Telehandler to hose out a Grout Hog. The employer did not ensure the employee was elevated on specifically designed personnel work platform approved by the telehandler manufacturer.
