29 CFR 1910.272(j)(2)(ii): The employer did not immediately remove any fugitive grain dust accumulations whenever they exceed 1/8 inch (.32 cm) at priority housekeeping areas, pursuant to the housekeeping program, or did not demonstrate and assure, through the development and implementation of the housekeeping program, that equivalent protection was provided:  The employer does not clean immediately any fugitive grain dust accumulations whenever they exceed 1/8 inch at priority housekeeping area, pursuant of the housekeeping program, or does not demonstrate and assure, through the development and implementation of the housekeeping program that the equivalent provides protection.   a. This violation was observed on or about January 29, 2013, in the grain facility where the employer exposed the employees to a fire or explosion hazard when performing grain handling duties without immediately removing the fugitive grain dust that was allowed to accumulate between 1/8 and 1/4 inch at the silo 19 access hatch area.  b. This violation was observed on or about January 29, 2013, in the grain facility  where the employer exposed the employees to a fire or explosion hazard when performing grain handling duties without immediately removing the fugitive grain dust that was allowed to accumulate to a level of 1 inch at the silo 12 side bridges area.  c. This violation was observed on or about January 29, 2013, in the grain facility where the employer exposed the employees to a fire or explosion hazard when performing grain handling duties without immediately removing the fugitive grain dust that was allowed to accumulate to a level of 2 3/4 inches at the magnet separator floor level area.   d. This violation was observed on or about January 29, 2013, in the grain facility where the employer exposed the employees to a fire or explosion hazard when performing grain handling duties without immediately removing the fugitive grain dust that was allowed to accumulate to a level of 1 inch at the top unloading hopper area.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the employer immediately remove any fugitive grain dust accumulations whenever they exceed 1/8 inch at priority housekeeping area, pursuant to the housekeeping program, or demonstrate and assure, through the development and implementation of the housekeeping program, that equivalent protection was provided.
