29 CFR 1926.300(b)(4)(ii):The point of operation of machines whose operation exposes an employee to injury, were not guarded: (a) Near the exterior north side of the house under construction on or about February 12, 2013, the homemade table saw did not have a hood guard for the portion of the blade above the table and the material being cut. This saw was used to cut forms for concrete.

29 CFR 1926.304(f): All woodworking tools and machinery did not meet applicable requirements of American National Standards Institute, 01.1-1961, Safety Code for Woodworking Machinery 3.1.3 (c) On applications where injury to the operator might result if motors were to restart after power failures, provision shall be made to prevent machines from automatically restarting upon restoration of power: (a) Near the exterior north side of the house under construction on or about February 12, 2013, the homemade table saw did not have a means to prevent restart after power failures. The switch used to turn power off and on to the machine's motor was an ordinary single pole switch. This saw was used to cut forms for concrete.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, were not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures. (a) In the first level and near the west side exterior of the house under construction on or about February 12, 2013, 16 penny nails protruded 1 to 2 inches from plywood and 2 by 4s that was used for concrete formwork. The wood with protruding nails was scattered everywhere and not kept clear of passageways and work areas.
