29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: This violation occurred on February 14, 2013, at a workplace located at 6835 St Francis Ct., Irving, TX 75062; where at least three (3) employees used ladder to access/egress the roof and the ladder side rails did not extend at least 3 feet above landing level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: This violation occurred on February 14, 2013, at a workplace located at 6835 St Francis Ct., Irving, TX; where at least three (3) employees, who were working on the roof, were not protected from falling to the ground below. The New Horizon Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314185331, citation number 1, item number 3 and was affirmed as a final order on 11/04/13, with respect to a workplace located at 408 San Bernard Drive, Irving, TX 75039.
