29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. (a) At Naval Base Guam, Building 6A, on or about February 14, 2013, eye protection was not worn and gloves were not used while rolling on Sherwin Williams A-100 latex exterior finish paint onto the exterior of building. The material safety data sheet stated avoid contact with skin and eyes.

29 CFR 1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a material safety data sheet for each hazardous chemical they produce or import. Employers shall have a material safety data sheet in the workplace for each hazardous chemical which they use. (a) At Naval Base Guam, Building 6A, on or about February 14, 2013, there were no material safety data sheets for hazardous chemicals at the work site. Employees applied Sherwin Williams A-100 latex exterior finish paint and other unidentified paint onto the exterior of the building.
