OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by a forklift in the event of a rollover:     a- Officemate International Corporation - The employer failed to require employees to wear restraint devices (i.e., seatbelts) when operating a forklift, exposing them to a crushing hazard in the event of a rollover.     Condition noted on or about 2/15/13.     Among other means, one feasible and acceptable method to correct the hazard would be for the company to require employees to utilize the seat belts and add this requirement to the employee's training program.

29 CFR 1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:     a- Officemate International Corp., Edison, NJ, Manufacturing Area - Employees required to perform maintenance/servicing on machinery such as but not limited to, the injection molding machines and wire drawing machines, were not provided with site specific documented procedures for de-energizing the machinery.  The employer's energy control program was general and not site specific.  The procedures shall include among other things:     - Specific machinery and the energy source associated with that machine.   - Specific location of the energy sources   - Means to isolate the sources, i.e., locks/tags   - Training requirements for authorized employees.     Condition noted on or about 4/12/13.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).     a- Officemate International Corp., Throughout facility - Forklift training and evaluation was not provided to all employees who are required to operate forklift trucks.     Training shall consist of among other things:     - Formal training to include truck related topics and workplace related topics;   - Practical training to include demonstrations by the trainer;   - Evaluation of the operator's performance in the workplace.     The employer must also certify that each employee was trained and evaluated.  The certification is to include, but not be limited to, the name of the operator, the date of the training or the evaluation, the name of the person providing the training or evaluation.       Condition noted on or about 2/15/13.
