29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    Maintenance Shop:  On or about 15 February 2013, and times prior thereto, employees operating fork trucks in the maintenance shop were not formally trained how to safely operate the fork trucks in the work area; exposing employees to struck by hazards.

29 CFR 1917.27(b)(1): Employees newly assigned to supervisory duties did not satisfactorily complete the accident prevention course within 90 days of the assignment.    (a) M/V APL Phillipines:  On or about 2/14/2013 and times prior thereto, the cargo operations supervisory staff were not formally trained in operational safety by completion of an accident prevention course; exposing employees to workplace hazards on the terminal such as but not limited to:            (1)  Fall hazards where employees were working at heights while conducting longshore operations;          (2)  Struck by hazards were employees were operating forklifts without training / certification;          (3)  Fire and water hazards where longshore employees were working without an adequate emergency evacuation                  plan or training for terminal and vessel operations.

29 CFR 1917.154:   Employees shall be protected by chip guarding and personal protective equipment complying with the provisions of Subpart E of this part during cleaning with compressed air. Compressed air used for cleaning shall not exceed a pressure of 30 psi. Compressed air shall not be used to clean employees.  Terminal Maintenance Shop:  On or about 2/14/2013, and times prior thereto, an air nozzle was used for cleaning purposes that measured over 120 psi without reduction; exposing employees to a laceration hazard.
