29 CFR 1918.85(k)(11): When fall protection systems required by 29 CFR 1918.85(j) were employed, inspections were not made by designated persons and defective components were not removed from service. a) M/V APL Philippines, Terminal One, Gear Van: On or about 14 February 2013 and times prior thereto, a Protecta International self-retracting life line swivel lock was rusted and seized due to being left out in the marine environment. This condition exposed employees to a fall hazard. b) M/V APL Phillipines, Terminal One: On or about 15 February 2013 and times prior thereto, an employee was wearing a fall protection harness that was loose and not properly fitted to the worker. this condition exposed employees to a fall hazard.

29 CFR 1918.85(k)(12): When fall protection systems required by 29 CFR 1918.85(j) were employed, employee(s) were not trained, before using any fall protection system, in the use and application limits of the equipment, proper hookup, anchoring and tie-off techniques, methods of use, and proper methods of equipment inspection and storage. a) M/V APL Philippines, Terminal One, Container unloading/loading area: On or about 14 February 2013 and times prior thereto, personnel were not wearing fall protection harness correctly in that it was loose and not completely secured to the worker. This condition exposed employees to a fall hazard.

29 CFR 1918.100(a): An employer did not develop or implement an emergency action plan. M/V APL Philippines, Terminal One: On or about 14 February 2013 and times prior thereto, the employer did not have an emergency man overboard procedures for personnel working on the loading docks. This condition exposed employees to a drowning hazard. APL Limited was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1918.100(a), which was contained in OSHA inspection number 307504241, citation number 01, item number 05 and was affirmed as a final order on 3/30/2009, with respect to a workplace located at Terminal One, Dutch Harbor, AK.
