29 CFR 1910.23(a)(1):     Every stairway floor opening was not guarded by a standard railing constructed in accordance with paragraph (e) of this section:     Employees were exposed to fall hazards because the north side of the stairway floor opening on the mezzanine was not guarded by a standard railing or its equivalent.  The open sided floor was approximately 8.8 feet from the floor to the concrete surface below.

The open sided floor was approximately 8.8 feet from the floor to the concrete surface below.

29 CFR 1910.147(c)(4)(i):     Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:     The employer has not developed, documented, nor enforced a hazardous energy control procedure for servicing the Bystronic laser cutting machines.  The machine safeguards are by-passed or otherwise inoperative, and the machine's hazardous energy is not isolated and rendered safe, employees are exposed to the hazard of being struck-by and/or caught-in the machine's moving parts tables.     To abate this violation the employer must take steps to ensure that lockout/tagout procedures are developed, documented, utilized and enforced for the control of hazardous energy while employees are in the area.     Pursuant to 29 CFR 1903.19, the employer must submit documentation describing the steps it is taking to ensure compliance, including the development, documentation and utilization for the control of potentially hazardous energy.

29 CFR 1910.212(a)(1):     One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:     On or about February 22, 2013, employees working in and around the "transport area" of the Bystronic laser cutting machine number 1121 are exposed to struck-by and caught-in hazards due to the following:     a.  the East side of the "transport area" is not guarded with a barrier guard; and,     b.  the presence sensing device (light curtains) on the West, North and South sides of the "transport area" does not provide adequate protection.     To abate this violation, the employer must ensure that properly applied guarding and/or safeguarding devices are provided to protect employees who enter or work within the "transport area".  Such guarding and/or safeguarding devices must be operational during all modes of operation.          Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including the installation of machine guarding.
