OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees      Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish  employment and a place of employment which were free from recognized hazards  that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing injuries:     Employees working in the Paint Department were exposed to the hazard of being crushed by a load suspended from the hoist because the lifting devices were not marked with the rated load where it was visible and a nameplate of the permanent marking was not affixed on the lifting device containing the manufacturer name and address, serial number, lifter weight and the rated load.

29 CFR 1910.147(c)(7)(i):     The employer did not provide training to ensure that the purpose and function of the energy control program was understood by the employees and that the knowledge and skill required for the safe application, usage and removal of the energy controls was acquired by the employees:     An employee was required to clean the Lissmac, and the employer had not developed an energy control program which includes training to ensure the purpose and function of the program was understood by the employees who operate the Lissmac.

29 CFR 1910.212(a)(3)(ii):     Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):       Employees are exposed to the hazard of getting their hands/fingers caught in the point of operation on the:     a.  Pullmax Press Brake, Type EKP CNC 110, Machine Number 3390.  The employer fails to ensure the use of light curtains to protect the point of operation.       b.  Bystronic Press Brake, Model Number Xpert 200 x 4100, Serial Number 11540022.  The employer fails to ensure the use of light curtains to protect the point of operation.      This violation was most recently observed between the dates of February 22, 2013 and May 7, 2013.  To abate this violation, the employer must ensure the light curtains are working and guard all points of operation and take steps to ensure the light curtains are operational and the guards remain in place while employees are in the area.       Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is talking to ensure compliance, including the installation of machine guarding.
