29 CFR 1910.134(a)(1): When effective engineering controls were not feasible or while they were being instituted, appropriate respirators were not used pursuant to the requirements of 29 CFR 1910.134: a) On 03/05/13, a Welder on Table No.7 was exposed to 1.23 times the 8 hour Time Weighted Average (TWA) Permissible Exposure Limit of 10 mg/M3 for iron oxide fume. Welders on Table No. 7 were not using respiratory protection. b) On 03/05/13, a Welder on the Dealer Tire Drill Line was exposed to 1.15 times the 8 hour Time Weighted Average (TWA) Permissible Exposure Limit of 10 mg/M3 for iron oxide fume. Welders on the Dealer Tire Drill Line were not using respiratory protection. Abatement Documentation and Abatement Certification required.

29 CFR 1910.252(c)(1)(iii): Local exhaust or general ventilating systems were not provided and arranged to keep the amount of toxic fumes, gases, or dusts below the maximum allowable concentration as specified in 29 CFR 1910.1000: a) The Welder on Table No. 7 was exposed to 1.23 times the Permissible Exposure Limit for iron oxide fume. The downdraft ventilation system built into the Table No. 7 did not maintain the employee exposure to iron oxide below the Permissible Exposure Limit. b) A Welder on the Dealer Tire Drill Line was exposed to 1.15 times the Permissible Exposure Limit for iron oxide. No exhaust ventilation was installed in the Dealer Tire Drill Line area. Abatement Documentation and Abatement Certification required.

An 12.3 mg/M3 is 1.23 times the 8 hour Time Weighted Average Permissible Exposure Limit concentration of 10 mg/M3. b) On 3/5/13, a Dealer Tire Drill Line Welder was exposed to an 11.5 mg/M3 8 hour Time Weighted Average concentration of Iron Oxide Fume. An 11.5 mg/M3 is 1.15 times the 8 hour Time Weighted Average Permissible Exposure Limit concentration of 10 mg/M3. Abatement Documentation and Abatement Certification required.
