29 CFR 1910.147(c)(6)(i)(A): The periodic inspection shall be performed by an authorized employee other than the ones(s) utilizing the energy control procedure being inspected.    On or about June 6, 2020, an employee of Steel King Industries, Inc. conducted the periodic inspection of the energy control procedures for the Rafter Mill and HF Welder while serving as both the inspector and employee utilizing the energy control procedure.

29 CFR 1910.147(d): 29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) covered the following elements, however, the actions were not done in sequence as required by 29 CFR 1910.147 (d)(1)-(6):    On or about July 20, 2020, employees were exposed to machine hazards associated with moving parts when they engaged in set up activities on the Rafter roll form mill. The employer did not ensure that employees implemented energy control application steps prior to allowing them to complete set up activities with the guards disabled. The machine was not deenergized prior to the employees engaging in the servicing/maintenance activity.    As a result, the remaining applicable energy control elements, involving machine or equipment shutdown [1910.147(d)(2)], machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.    On or about July 29, 2020, employees were exposed to machine hazards associated with the operation of the Rafter roll form mill when a foot pedal could be used to mute the light curtains serving as the guard between the operators and the moving parts of the mill.

29 CFR 1910.1200(f)(6): Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either:  (i) The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or,  (ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  On or about July 29, 2020, employees were exposed to the health hazards associated with PURUS WAY Oil 2020 when a bottle used for lubrication of parts on the Rafter roll form mill was not labeled to identify the specific hazards of the chemical.
