29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly: A.) Ward Trucking, LLC - On or about 4/4/13, the company was utilizing forklift attachments that included but were not limited to the drum lift attachment. The drum lift attachment was utilized on a 50 Nissan Optimum propane forklift (serial #CPOZA25PV). The company had not received written manufacturer's approval to utilize the attachment on the forklift.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: A.) Ward Trucking, LLC - On or about 4/4/13, the company was utilizing forklift attachments that included but were not limited to the drum lift attachment. The fork truck was not equipped with plates/markings to reflect the drum lift attachment. The drum lift attachment was utilized on forklifts that included but were not limited to, the 50 Nissan Optimum propane forklift (Serial # CPOZA25PV).
