OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to cleaning with compressed air which could result in fire hazards: (a) Facility: On or about March 23, 2013, an employee was cleaning with compressed oxygen. This condition increases the potential for fire hazards to employees.

29 CFR 1915.152(a): The employer did not provide or ensure each affected employee with the appropriate personal protective equipment (PPE) for the eyes, face, head, extremities, torso, and respiratory system, including protective clothing, protective barriers, personal fall protection equipment, and life saving equipment, meeting the applicable provisions of Subpart I, wherever employees were exposed to work activity hazards that required the use of PPE: (a) Facility: On or about March 23, 2013 an employee was not wearing flame retardant clothing when he was using a cutting torch. (b) Facility: On or about April 1, 2013, an employee was wearing flame retardant clothing when he was using a cutting torch. (c) Facility: On or about April 3, 2013, two employees were welding and they were not wearing at a minimum flame retardant clothing. (d) Facility: On or about April 3, 2013, an employee was using a cutting torch and welding and he was not wearing at a minimum flame retardant clothing.
