29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a) At the facility, on or about March 4, 2015 - The employer did not establish a written respiratory protection program.  Employees are required to wear half face respirators in the Old Wheelabrator shop, permit required confined spaces and full face respirators in the Paint Shop. An employee on the Panel Line had an 8-hr TWA exposure to zinc oxide fume above the permissible exposure limit. An employee in the Mid-Body Section Assembly Area had an 8-hr TWA exposure to zinc oxide fume and copper fume above the cumulative exposure limit.    1910.134(c)(1) is applicable to shipyard employment by 1915.154 that incorporates the General Industry requirement.

29 CFR 1915.1000(a)(2): An employee's exposure to any substance in Table Z - Shipyards, the exposure limit of which is not preceded by a "C", shall not exceed the 8-hour Time Weighted Average given for that substance during any 8-hour work shift of a 40-hour work week:     a) On the Panel Line, on or about April 8, 2015 - A Welder was inspecting the welds of an automatic welder and was exposed to zinc oxide fume at a time weighted average exposure of 9.49 mg/m3.  This level is 1.9 times the permissible exposure limit of 5 mg/m3 as a time weighted average concentration.  Sampling was performed by an OSHA compliance officer on April 8, 2015 for 388 minutes and zero exposure was assumed for the unsampled portion of the shift.    b) In the Mid-Body Section Assembly Area, on or about April 8, 2015 - A Welder was welding angles to bulkheads and was exposed to iron oxide fume at a time weighted average exposure of 13.7 mg/m3.  This level is 1.4 times the permissible exposure limit of 10 mg/m3 as a time weighted average concentration.  Sampling was performed by an OSHA compliance officer on April 8, 2015 for 364 minutes and zero exposure was assumed for the unsampled portion of the shift.

The equivalent exposure of the mixture was 1.5 times the cumulative exposure limit.  Sampling was performed by an OSHA compliance officer on April 8, 2015 for 364 minutes and zero exposure was assumed for the unsampled portion of the shift.

29 CFR 1915.51(d)(3): Employees welding, cutting, or heating in the open air, involving metals containing zinc-bearing base or filler metals or metals coated with zinc-bearing materials were not protected by filter type respirators:  a) In the Stern Shop, on or about March 26, 2015 - A Fitter was building a stern by MIG welding frames made of A36 mild steel coated with Interplate Zero Water Based Inorganic Shop Primer.  Interplate Zero Water Based Inorganic Shop Primer contains zinc and the Fitter was not wearing a respirator.    b) On the Panel Line, on or about April 8, 2015 - A Welder was inspecting the welds of an automatic welder to ensure the proper angle of panels.  Panels are made of A36 mild steel coated with Interplate Zero Water Based Inorganic Shop Primer.  Interplate Zero Water Based Inorganic Shop Primer Contains zinc and the Welder was not wearing a respirator.
