29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not netralized, power was not shut off, and brakes set. At 165A Leon Guerrero Street, Harmon Industrial Park, Guam on April 17, 2013, the Yale Forklift, serial number EJ0643 was parked on an incline and was unattended. The wheels on the forklift was not blocked to prevent against accidental movement.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service: At 165A Leon Guerrero Street, Harmon Industrial Park, Guam on April 17, 2013, the Yale Forklift, serial number EJ0643 was not examined before being placed in service. The horn was defective/inoperative. Employee used the forklift to move pallets of food supply.

29 CFR 1910.22(d)(1): On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate. Above the main office on April 17, 2013, office furniture and miscellaneous materials were stored on top of the office roof. There was no maximum safe load limit marking posted to prevent possible overloading.
