Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire/explosion hazards: (a) On or about April 22, 2013, for employees exposed to fire and explosion hazards while working on and around a diesel-powered rig pump with known ignition sources approximately 15 feet from an open-top return tank with crude oil and/or other hydrocarbons present at Binstock 1-34-27H-142-96, Manning, ND. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that "Discharges of oil or gas to the atmosphere should be to a safe area, preferably on the downwind side of the well and a minimum of 100 ft (30.5 m) from the wellhead, open flame, or other sources of ignition.", as described in Section 12 of the American Petroleum Institute - Recommended Practice 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations.

Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) On or about April 22, 2013, for employees exposed to struck-by hazards while working on and around the operational service rig where the employer did not ensure that each section of a high-pressure rigid line transporting fluid to the well was secured using appropriate means to prevent movement should the line fail due to a kick at Binstock 1-34-27H-142-96, Manning, ND. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that each section of a high-pressure rigid line is secured using appropriate means to prevent movement should the line fail as described in Section 9 of the American Petroleum Institute - Recommended Practice 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations.
