OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) Various jobsite locations: On or about January 12, 2015, the employer did not identify the hazards and develop procedures for the employees working on uneven surfaces while trying to lock their containers into place which would then emptied into their trucks. (b) Various jobsite locations: On or about January 12, 2015, the employer did not refer employees to the manufacturers instructions to ensure that correct operating procedures were being followed. At times employees would push containers with their hands to get the containers to line up with the trucks, contradicting the manufacturers manual.
