Kuneman Construction, Inc., 2911 West 12th Street, Erie, PA 16505, northwest side of the structure, on or about April 18, 2013 and times prior thereto: Employees were accessing and working on the top platform of a tubular welded frame scaffold. The end of the scaffold's top platform was not equipped with a top rail exposing employees to a fall hazard of 13.8 feet. B.) J.M. Kuneman Construction, Inc., 2911 West 12th Street, Erie, PA 16505, north side of the scaffold, on or about April 18, 2013 and times prior thereto: Employees on the tubular welded frame scaffold performed work tasks, including, but not limited to, nailing wire mesh to the building, parging and brickwork. The end of the scaffold outrigger platform was not equipped with a top rail exposing employees to a fall hazard of 11.7 feet.

Kuneman Construction, Inc., 2911 West 12th Street, Erie, PA 16505, northwest side of the structure, on or about April 18, 2013 and times prior thereto: Employees were accessing and working on the top platform of a tubular welded frame scaffold. The end of the scaffold's top platform was not equipped with a top rail exposing employees to a fall hazard of 13.8 feet. The scaffold was released by the competent person for employees use prior to the installation of the top rail. B.) J.M. Kuneman Construction, Inc., 2911 West 12th Street, Erie, PA 16505, north side of the scaffold, on or about April 18, 2013 and times prior thereto: Employees on the tubular welded frame scaffold performed work tasks, including, but not limited to, nailing wire mesh to the building, parging and brickwork. 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: A.) J.M. Kuneman Construction, Inc., 2911 West 12th Street, Erie, PA 16505, northwest side of the structure, on or about April 18, 2013 and times prior thereto: An employee performed work tasks, including, but not limited to, nailing wire mesh to the building and parging. While performing these tasks, the employee was walking, working and standing on the upper/lower roof structures of the building and was not utilizing a means or methods of fall protection when exposed to a fall hazard of at least 10 feet. B.) J.M. Kuneman Construction, Inc., 2911 West 12th Street, Erie, PA 16505, northwest side of the structure, on or about April 18, 2013 and times prior thereto: Employee was accessing /egressing the lower roof structure of the building from a scaffold. The employee was not utilizing a means or method of fall protection while traveling back and forth from the scaffold and the roof. Condition exposed personnel to a fall hazard of at least 10 feet.
