OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Comte Construction Company on or about April 23, 2013, at the address of 5600 W. Sylvania Ave. Toledo, OH: The employer did not ensure sufficient and correctly installed temporary bracing was applied to the 45 ft. 3 in. wood trusses erected onsite. Employees working in this condition were exposed to struck-by hazards. One feasible means of abatement to is to install temporary bracing as outlined in the 2008 Building Component Safety Information (BCSI): Guide to Good Practice for Handling, Installing, Restraining & Bracing of Metal Plate Connected Wood Trusses is produced jointly by the Wood Truss Council and the Truss Plate Institute, Section B2-Truss Installation and Temporary Restraint/Bracing.

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within the four business hours. a) Comte Construction Company on or about April 26, 2013, following the inspection at the address of 5600 W. Sylvania Ave. Toledo, OH: The employer did not provide the representative of the Dept. of Labor, OSHA 300 logs for the year 2013 upon request in a timely manner. Three requests were made on three different days to the company representative, requesting records kept under Part 1904.
