Section 5(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire/explosion hazards:     (a)   On or about April 26, 2013, for employees exposed to fire and explosion hazards while working on and around a diesel powered rig pump with known ignition sources approximately 20 feet from an open-top return tank with crude oil and/or other hydrocarbons present at Hans 20-21H, Killdeer, ND.    Abatement Note:  Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that "Discharges of oil or gas to the atmosphere should be to a safe area, preferably on the downwind side of the well and a minimum of 100 feet (30.5 m) from the wellhead, open flame, or other sources of ignition.", as described in Section 12 of the American Petroleum Institute - Recommended Practice 54, "Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations".

Section 5(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:     (a)   On or about April 26, 2013, for employees exposed to struck-by hazards while working on and around high pressure rigid lines and flexible high pressure hoses where the employer did not ensure that each section of a high pressure rigid line and flexible high pressure hose transporting fluid from the well was secured using appropriate means to prevent movement should the line fail due to a kick at Hans 20-21H, Killdeer, ND.     Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that each section of a high pressure rigid line is secured using appropriate means to prevent movement should the line fail as described in Section 9 of the American Petroleum Institute - Recommended Practice 54, "Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations".
