29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: (a) Stairway, new residential construction located at 4184 Lilycrest Way, Powder Springs, GA.: Employees used a stairway with no stair rails to access the second floor exposing employees to falls to lower levels. The stairway was 7 risers high with the top landing height at approximately 5 feet from the ground floor.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) 4184 Lilycrest Way, Powder Springs, Ga.: Three employees were exposed to fall hazards of approximately 23 feet, 7-inches to the ground while engaged in framing activities on 2nd level of new construction without fall protection in place on 04/22/2013.

The employees were not wearing fall protection.
