29 CFR 1926.304(d):Guarding. All portable, power-driven circular saws shall be equipped with guards above and below the base plate or shoe. The upper guard shall cover the saw to the depth of the teeth, except for the minimum arc required to permit the base to be tilted for bevel cuts. The lower guard shall cover the saw to the depth of the teeth, except for the minimum arc required to allow proper retraction and contact with the work. When the tool is withdrawn from the work, the lower guard shall automatically and instantly return to the covering position. On or about January 3, 2025 at approximately 1240hrs, on a residential construction site in vicinity of 769 Rustic Ridge Lavon, TX 75166. Employee was operating a DeWalt circular saws with modified guards exposing employees to point of operation machine guarding hazard.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about January 3, 2025 two employees were exposed to fall hazards while installing framing lumber on the second level of a residential building under construction.
