29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Jobsite, 1003-1023 South 17th Street - An employee was installing windows within 1' of an unprotected 5' x 5' window opening 31'10" above ground level without adequate fall protection, observed on or about 4/24/13.  b) Jobsite, 1003-1023 South 17th Street - An employee was installing windows within 1' of an unprotected 5' x 5' window opening 20'9" above ground level without adequate fall protection, observed on or about 4/24/13.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Jobsite, 1003-1023 South 17th Street - An employee was installing windows within 1' of an unprotected 5' x 5' window openings up to 31'10" above ground level without being trained in fall protection. The employee did not know the anchorage strength for anchor points in construction on or about 4/24/13.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use: Note:  Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift.    a) Jobsite, 1003-1023 South 17th Street - An employee was installing windows from an unprotected pallet placed upon the forks of a SkyTrak Model 8042, thus exposing the employee to fall hazards up to 32 feet without adequate fall protection, observed on or about 4/24/13.
