29 CFR 1926.20(b)(2):  The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.       a) Cantor Trail, Cherry Hill, NJ:  On or about 6/20/2013 the employer Montes Belos Construction, did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, four workers doing framing work from the second story top plate were not using fall protection and were thus exposed to fall hazards of greater than 22 feet, from the roof to the ground.  Additionally, an aluminum extension ladder with damaged rungs was used to access the upper levels of the structure and and damaged extension cord was used to power a circular saw.       NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.403(b)(1):  Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause serious physical harm to employees:  a) Cantor Trail, Cherry Hill, NJ:  On or about 6/20/2013 the employer did not initiate a program to ensure that electrical equipment was free of recognized hazards.  As such, Montes Belos Construction employees were exposed to potential serious physical harm from a damaged extension cord used to power a circular saw.

29 CFR 1926.1053(b)(16):  Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.    a) Cantor Trail, Cherry Hill, NJ:  On or about 6/20/2013 four Montes Belos Construction employees doing framing work from the second story top plate were using an aluminum extension ladder with damaged and bent rungs to access the upper levels of the structure.
