OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an amputation hazard while using the Cincinnati Press Brake: Southern Perfection Fabrication Holdings, Inc., Byron, GA - In the Fabrication Shop, employees were using a foot pedal to operate the Cincinnati Press Brake, serial no. 01290. The cover of foot pedal was broken exposing the pedal to accidental actuation by a falling object, or by someone stepping on it, on or about May 7, 2013. Among other methods, a feasible abatement method to correct this hazard is to follow the American National Standard B11.3, Power Press Brakes Safety Requirements for Construction, Care, and Use, paragraph 4.3.4.3, which states that a foot control, if used, shall be protected so as to inhibit accidental actuation by falling or moving objects, or by someone stepping on it.
