OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to the hazards of being crushed by heavy equipment.   On or about May 9, 2013, the employer failed to ensure that there were no modifications made to the Vermeer rocksaw, model V5750, that would alter the performance, such as securing the throttle in the full acceleration setting with rope.  Failure to operate machinery in accordance with the designed settings can lead to loss of control of the machine, exposing employees to the hazard of being struck by the machine.

29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not available at the worksite to render first aid.    On or about, May 9, 2013, at 6307 W Courtyard, Austin TX, employee(s) were exposed to the hazards associated with a delay of medical response. No employee on site had attended an approved certified first aid training class.
