29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Employees were exposed to fall hazards when working from the platform around the Voeller Pan Cyclo Mixer and when getting on top of the mixer to open the mixer hatches during cleaning because the working surfaces were not guarded with standard railings and toeboards.

29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: Employees are exposed to permit-required confined spaces, such as but not limited to, the Voeller Pan Cyclo Mixer, during operation and when entering the equipment to performing cleaning and the employer has not posted danger signs or other means of identifying the permit-required confined space.

29 CFR 1910.146(c)(7)(iii): The employer did not document the basis for determining that all hazards in a permit space had been eliminated, through a written certification that contained the date, the location of the space, and the signature of the person making the determination. Employees were exposed to permit-required confined spaces, such as but not limited to, the Voeller Pan Cyclo Mixer, during operations and when entering the equipment to performing cleaning and the employer did not complete a written certification to reclassify the space for each entry. The employer evaluated the space on January 7, 2005, and considered the space to be permanently reclassifed.
