On or about May 23, 2013, personnel conducting work activities in the excavation were not utilizing hardhats to protect from falling rocks, dirt or other objects.

29 CFR 1926.651(h)(1): Employees worked in excavations in which there was accumulated water, or in excavations in which water was accumulating: a) construction site of new bank building at 1 S. 2nd St. in Clearfield, PA - Elevator Pit Excavation. On or about May 23, 2013, personnel were in an excavation that was 15-feet in depth while conducting work activities that included but were not limited to framing and pouring the building footers. The water pump had been removed from the excavation for the elevator and water had accumulated in the pit. Adequate precautions were not taken to protect employees from a cave-in hazard due to water accumulation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) construction site of new bank building at 1 S. 2nd St. in Clearfield, PA - On or about May 23, 2013, personnel were in an excavation that was 9.6-feet in depth while conducting work activities that included, but were not limited to, framing and pouring the building footers. The sloping/benching protective system was constructed for Type B soil but was not reclassified to Typce C soil due to wet conditions thus creating an excavation that was not constructied in accordance with Subpart P Excavations - 29 CFR 1926.652(b)(1) through 29 CFR 1926.652(b)(4).

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirements of paragraphs (b)(1), (b)(2), (b)(3) or (b)(4): a) construction site of new bank building at 1 S. 2nd St. in Clearfield, PA - Elevator Pit Excavation. On or about May 23, 2013, personnel were in an excavation that was 15-feet in depth while conducting work activities that included but were not limited to framing and pouring the building footers. The sloping/benching protective system was not constructed in accordance with the 29 CFR 1926.652(b)(1) through 29 CFR 1926.652(b)(4) in that the excavation was not sloped properly for a Type C soil. In addition, the benches exceeded the height parameters for even a Type B soil allowed by Appendix B of Subpart P of this standard.
