29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part. a) Lot 31, Northern View Homes, St. George, DE-Employees were observed framing a newly constructed home without a safety and health program. On or about 5/22/13. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Lot 31, Northern View Homes, St. George, DE-Employees were observed framing a newly constructed home at approximately 9 feet from the ground level without fall protection. On or about 5/22/13. Roncone Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 893972, citation number 01, item number 01 and was affirmed as a final order on 04/12/2013, with respect to a workplace located at 16 Eagle Lane, Lakewood NJ 08701
