29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the angle was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):    a) Jobsite, 7-13 Bank Street, Philadelphia - Employees were installing footings in an excavation approximately 60 feet long and 40 wide, ranging from approximately 7 feet to 10 feet deep, in which the walls of the excavation were sloped at angles steeper than 34 degrees and the employees were not protected from cave-ins.  Observed on or about August 23, 2013.

29 CFR 1926.651(i)(3): Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures.  a) Jobsite, 7 - 13 Bank Street, Philadelphia:  Employees were installing footings in an excavation in which the sidewalk at the front of the excavation was undermined and an adequate support system was not provided to protect employees from possible collapse of the sidewalk.  Observed on or about August 23, 2013.
