29 CFR 1926.1053(a)(2): Ladder rungs, cleats, and steps were not uniformly spaced when the ladder was in position for use:   a) Roncone Construction (1200 Ellsworth, Philadelphia): Employees (Laborers) used a wooden job-made ladder to access the second floor of the building under construction. The rungs of the ladder were not uniformly spaced in that a distance of 17 inches was measured between the floor and the first rung, 14.5 inches between the first and second rungs and 19 inches between the second and third as well as the third and fourth rungs. On or about July 24, 2013.

29 CFR 1926.1053(a)(2): Rungs, cleats, and steps of fixed ladders (including individual-rung/step ladders) were spaced more than 14 inches (36 cm) apart, as measured between center lines of the rungs, cleats and steps.   a) Roncone Construction (1200 Ellsworth, Philadelphia): Employees (Laborers) used a wooden job-made ladder to access the second floor of the building under construction. The rungs of the ladder were spaced more than 14 inches apart in that a distance of 17 inches was measured between the floor and the first rung, 14.5 inches between the first and second rungs and 19 inches between the second and third as well as the third and fourth rungs. On or about July 24, 2013.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems:  a) Roncone Construction, LLC (1200 Ellsworth, Philadelphia): An employee (Laborer) while working from the uppermost level of a building under construction was exposed to a fall hazard of at least twenty feet. The employee was not provided with any means of fall protection. On or about July 24, 2013.   b) Roncone Construction, LLC (1200 Ellsworth, Philadelphia): Employees (Laborers) accessed and exited the second floor of the building under construction by using a wooden job-made ladder adjacent to an opening extending approximately 116 inches (9.6 feet) to the lower basement level exposing the employees to fall hazards. The employees were not provided with a means of fall protection at the opening. On or about July 24, 2013.  Roncone Construction, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 909034, citation number 1, item number 1and was affirmed as a final order on September 3, 2013 with respect to a workplace located at Eden Court, Lot 5.04, Lakewood, NJ 08701.

The employee was not provided with training concerning the need for and use of fall protection. 29 CFR 1926.1051(a): A stairway or ladder was not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:  a.)  Roncone Construction, LLC (1200 Ellsworth, Philadelphia): Employees (Laborers) entered and exited the first floor of the building under construction at a point where there was a break in elevation of approximately 33 inches. The employee were not provided with a means to enter the first floor of the building where the break of elevation was 19 inches or more. On or about July 24, 2013.   Rancone Construction, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.1051(a) which was contained in OSHA inspection number 909034, citation number 1, item number 3 and was affirmed as a final order on September 3, 2013 with respect to a workplace located at Eden Court, Lot 5.04, Lakewood, NJ 08701.
