On or about June 20, 2013, the employer did not initiate and maintain such programs to ensure worker safety, inclugin a program of frequent and regular inspections persons it designates, to ensure workers use appropriate fall protection, the safe use of ladders and to promptly correct safety and health hazards.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

Employees at the site listed above were exposed to safety hazards, including but not limited to falls. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):      The employer does not ensure the use of of fall protection during roofing work. This violation was most recently observed at 435 S. Tenth Street, Dekalb, IL 60178, where two employees were not protected from fall hazards of eighteen and ten feet to the ground. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.     This employer has been cited for this practice that included: Tip Top Roofing and Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA violation number 311250203, citation 1, item 3, issued on May 29, 2008, and became a final order on or about June 25, 2008 with respect to a workplace located at 1500 West Gate, Rochelle, IL 60168, OSHA violation number 312721533, citation 2, item 1, issued on December 15, 2008, and became a final order on or about January 15, 2009, with respect to a workplace located at 429 N. 7th Street, DeKalb, IL 60115, and OSHA violation number 312730542, citation 1, item 2, issued on December 19, 2009, and became a final order on or about January 29, 2010, with respect to a workplace located at 620 W. Roosevelt Road, Wheaton, IL 60187.      This employer has been cited for this practice that included: Tip Top Roofing and Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), (b)(10), and (b)(11) which was contained in OSHA violation number 311253447, citation 1, items 2, 3, and 4 respectively, issued on October 16, 2008, and became a final order on or about November 19, 2008, with respect to a workplace located at Rout 23, Sycamore IL 60178.      This employer has been cited for this practice that included: Tip Top Roofing and Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.501(b)(1) which was contained in OSHA violation number 707859, citation 1, item 1, issued on December 3, 2012, and became a final order on or about January 4, 2013, with respect to a workplace located at 437 West State Street, Sycamore, IL 60178.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    The employer does not ensure all ladders extend at least 3 feet above the upper landing surface being accessed.  This violation was most recently observed at 435 S. Tenth Street, Dekalb, IL., 60178, where one employee used an extension ladder to access a landing surface eleven (11) feet from the ground and the ladder did not extend at least three feet above the landing surface.    Tip Top Roofing & Construction Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.1053(b)(1), which was contained in OSHA inspection number 707859, citation number 1, item number 2 and was affirmed as a final order on January 4, 2013, with respect to a workplace located at 437 West State St., Sycamore, IL 60178.
