29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck: The employer does not ensure that each operator had successfully completed the training required by paragraph (l) prior to allowing the employee to operate a powered industrial truck. This violation was observed on or about July 3, 2013 where an employee was exposed to struck-by hazards while operating a Hyster Forklift and had not received training on the safe operation of the forklift. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that before employees are allowed to operate the forklift they have received training in the safe operation of the forklift.

This violation was observed on or about July 3, 2013 at the plant where employees were exposed to electrical hazards on an ice machine power cord where the outer insulation had been pulled back from the plug. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that flexible cords and cables were connected to devices and fittings that would prevent pull from being directly transmitted to joints or terminal screws.
