29 CFR 1910.26(c)(3)(vii): Ladders were not used in a manner for which they were intended.     On or about July 11, 2013, at the facility, the employer did not ensure an employee was using a portable metal step ladder for the manner in which it was intended. An employee was observed straddled on the top cap of a portable metal step ladder while performing welding operations. This practice exposed the employee to the hazard of stumbling and falling from the ladder.

29 CFR 1910.178(l)(1)(ii): 29 CFR 1910.178(l)(1)(ii):  The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:     On or about July 11, 2013, at the shop, the employer did not ensure that each forklift operator received powered industrial truck operator training and evaluation. Employees operating forklifts to transport equipment for had not been certified and trained in the safe operations of the vehicle. This exposed employees to struck by hazards.

29 CFR 1910.303(g)(1)(ii): The required working space about electric equipment rated 600 volts, nominal, or less to ground, was used for storage:     On or about July 11, 2013, at the shop, the employer did not ensure an open working space was provided around enclosed live parts. The electrical cabinets located in the shop / east wall were blocked by wheeled carts loaded with equipment and tools. This condition exposed employees to delay in de-energizing equipment in case of an emergency.

29 CFR 1910.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI):  The employer is to make this determination in accordance with either paragraph (d)(2), the scheduled monitoring option, or paragraph (d)(3), the performance-oriented option.     On or about July 11, 2013, and at times prior thereto, the employer did not perform initial air monitoring to determine employee exposures to Chromium, Cr (VI). Employees performing Tungsten inert gas (TIG) welding on stainless steel  had not been monitored to determine the extent and degree of exposure to Cr (VI) at the worksite.  This practice created a condition for exposure to airborne chromate hazards to chromates.

29 CFR 1910.1026(i)(5): The employer did not ensure that employees did not eat, drink, smoke, chew tobacco or gum, or apply cosmetics in regulated areas, or in areas where skin or eye contact with chromium (VI) occurred:   On or about July 11, 2013, at the shop, the employer did not prohibit the consumption of beverages at employee's workstations where hazardous airborne fumes were being generated from activities associated with TIG welding on stainless steel. The practice exposed employees to the ingestion inhalation hazards associated with airborne chromate fumes.

29 CFR 1910.134(c)(2): The employer did not develop and implement a respiratory protection program in accordance with sections i and ii of this paragraph (c)(2) for employees who chose to wear respirators where respirator use was not required:     On or about July 11, 2013, at the facility, the employer did not provide Appendix D information to employees using respirators when not required to under the OSHA standard. Employees performing welding operations on stainless steel (such as Tungsten inert gas (TIG) welding, operating laser cutting machine) were voluntarily using respirators e.g. N95 dust masks to protect themselves from metal fumes containing Chromium, Cr (VI) .
